General terms and conditions for participation in courses organised by TOP-Course e.V.
TOP-Course e.V. has its registered office in D-82049 Pullach, Max-Reger-Straße 2.
§ 1 Services
[1] Unless otherwise agreed, TOP-Course e.V. provides course participants with the fol-lowing:
• Fully equipped seminar and function rooms
• Tutors with proven professional experience
• Catering during courses, by arrangement
• Overnight accommodation, by arrangement
• Course documentation
• Certificate of participation
[2] The course participant shall pay for such services within the context of the relevant course fees, unless otherwise agreed.
§ 2 Registration
[1] Registrations to take part in the courses organised by TOP-Course e.V. are required in writing.
[2] In the event of courses with restricted participant numbers, the order in which regis-trations are received shall determine who takes part.
[3] Registration is not an automatic claim for fulfilment.
§ 3 Confirmation/payment obligations
Unless otherwise agreed, the following terms apply:
[1] Upon receipt of the registration form or completion of online registration at TOP-Course e.V., and upon receipt of the course fee*, a binding agreement comes into effect between the participant and TOP-Course e.V.
[2] The course fees are due immediately once registration is complete.
[3] Prices are determined on the basis of the fees stated in the relevant course
programme.
Prices are subject to change – notification in the confirmation of registration shall apply.
[4] Course fees may be paid by bank transfer, direct debit (only applicable to payments within Germany) or credit card. Payments by credit card may be subject to fees charged by the credit card company and are payable by the cardholder.
§ 4 Modification, termination, cancellation**
[1] Cancellation by the course participant must be made in writing.
[2] In the event of participants subject to fees:
• If notice of cancellation is received by TOP-Course e.V. up to eight weeks prior to the start of a course (date of receipt applies), no costs are incurred with the exception of an administrative fee of 35.00 Euros.
• If notice of cancellation is received by TOP-Course e.V. between 55 and 28 days prior to the start of a course (date of receipt applies), 50% of the course fee shall be charged for cancellation unless the place can be otherwise filled.
• All other, later cancellations (date of receipt applies) are subject to 100% cancellation fees unless the place on the course can be otherwise filled.
• Evidence of lesser damages to TOP-Course e.V. must be provided by the course par-ticipant.
[3] § 627 BGB (German Civil Code) shall not apply.
The entitlement to extraordinary termination for cause shall not be affected hereby.
§ 5 Modification, cancellation** by TOP-Course e.V.
[1] TOP-Course e.V. is entitled to cancel or move courses on substantial grounds. Such grounds may be:
• Sickness or serious incapacity on the part of the tutor.
• Failure to reach the minimum number of course participants.
• Other reasons for which TOP-Course e.V. itself is not responsible.
[2] In the event of modification or cancellation, participants shall be informed as soon as possible in writing.
Course fees which have already been paid shall be refunded immediately if alternative dates offered cannot be honoured.
Otherwise no claims for a refund may be made.
§ 8 Final clauses
[1] No additional verbal agreements are made.
[2] Both contractual partners are entitled to store data pertaining to this agreement for internal purposes only. Transmission of such data to third parties is not permitted unless legally necessary.
[3] The place of fulfilment and payment is the registered address of TOP-Course e.V.
The court of jurisdiction for commercial matters is likewise the registered address of TOP-Course e.V.
[4] Should any clause of this agreement be, or become, invalid, the remaining contract shall not be affected. The ineffective clause shall be replaced by law. If no such law ex-ists, the contractual partners shall agree upon an appropriate regulation acceptable to both parties.
* Course fees are subject to value added tax.
The displayed prices are net, subject to the latest valid rate of VAT of 19%.
** We recommend the purchase of travel cancellation insurance.
